Terms of Service

These Terms of Service ("Terms") apply to your use of thehungrypixel.com, our free tools, our emails, and any services you buy from Leah Krabbenhoft, doing business as The Hungry Pixel ("The Hungry Pixel," "we," "us"). By using the site or our services, you agree to these Terms.

1. What we do

We set up and maintain advertising and analytics tracking for online stores. That can include server-side tracking, conversion APIs, Google Tag Manager, analytics and related reporting. We are not a media buying agency: unless we agree otherwise in writing, we do not run, manage or spend money on your ad campaigns.

2. Free tools and content

The Pixel Hunger Test, Store Scan, emails, articles and videos are for general information only. They are not legal, financial, tax or business advice. Scan results come from an automated check of public web pages, may be incomplete or wrong, and do not replace a full audit. Only scan stores you own or have permission to check.

3. No guaranteed results

Ad results depend on many things outside our control, including your products, offer, pricing, website, budget, competition and platform changes by Meta, Google and others. Examples, case studies and numbers on our site describe specific past situations. They are not promises or predictions. We do not guarantee any particular sales, revenue, profit, return on ad spend, cost per purchase or other result.

4. Quotes, payment and refunds

  • Each project gets a written quote or agreement after a free audit call. If that agreement conflicts with these Terms, the agreement wins.
  • One-time setup packages are billed 100% upfront, before work begins.
  • Monthly services ("Keep it fed") are billed in advance each month and continue until either side cancels with 30 days' written notice.
  • Third-party costs, such as server hosting (for example Stape), apps and ad spend, are paid by you directly to those providers and are not included in our fees unless the quote says so.
  • All fees are non-refundable once paid, because our services are delivered as the work is performed. Cancelling a monthly service stops future billing; it does not refund the current month.

5. What we need from you

  • Access to the accounts we need (for example Shopify, Google, Meta and your domain settings), granted through user or partner access, never by sharing passwords.
  • Accurate information and timely replies. Delays on your side may move our timeline.
  • Your own privacy policy, cookie banner and consent settings that fit your business and the laws that apply to you. We can recommend settings, but you are responsible for your site's legal compliance.

6. Your accounts and data

You own your ad accounts, analytics properties, tag containers and the data in them. We access them only to do the agreed work, and you can remove our access at any time. We handle any personal data in those accounts on your behalf and only to provide the services. When the work ends, we will remove our own access on request.

7. Platforms and third parties

We build on tools run by other companies, including Shopify, Google, Meta, Stape and Klaviyo. We are not responsible for their outages, policy changes, account restrictions or data processing. Changes they make may require updates to your setup, which may be billed separately.

8. Intellectual property

Our site, brand, content, templates, tools and methods belong to The Hungry Pixel. When you pay in full, you receive the right to use the setup and configuration we build in your accounts for your own business. You may not resell or redistribute our templates, guides or tools without written permission.

9. Acceptable use

Don't misuse the site or our tools. For example: don't overload or attack them, scrape them, get around rate limits, or use them to break the law or anyone's rights.

10. Disclaimers

The site, free tools and content are provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or ad spend. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim. Free tools carry no liability beyond what the law requires.

12. Indemnity

You agree to defend and hold us harmless from claims arising from your products, your website, your ads, your use of customer data, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Colorado, USA. Any dispute will be handled in the state or federal courts located in Summit County, Colorado, unless the law requires otherwise.

14. Changes

We may update these Terms. We will post the new version here with a new effective date. Signed agreements change only in writing.
